  1. General

The platform www.cvetitaherbal.com is owned by the Herbal world Foundation, BULSTAT: 176984987; registration number in the register of non-profit legal entities of the Ministry of Justice:  20160302004, registered as per the law of the republic of Bulgaria. 

CVETITA HERBAL, UIC: 203492157, with seat and registered address: BULGARIA, 8000 Burgas, 17, Graf Ignatiev Str., is our partner in the process of implementation of individual activities under this platform www.cvetitaherbal.com, including but not limited only to business activity.  These General Terms and Conditions represent a legal agreement between you in person and CVETITA HERBAL, UIC: 203492157, VAT No. BG203492157 (“Cvetita Herbal”).

PLAFORM FEATURES:

"Cvetita Herbal " is an e-trade platform accessible at: https://www.CvetitaHerbal.com, and by using this platform, Users can make purchase and sales contracts for delivery of articles as offered through this platform for sale by traders, including the following:

1. Perform registration and set up a profile for navigation in the Supplier’s e-shop, via the Cvetita Herbal platform and use additional services for supply of information,

2. Review the articles, their relevant features, process and terms of delivery,

3. Make contracts for purchase and sale of the articles as offered by the Supplier via the Cvetita Herbal platform,

4. Make all types of payments in relation to the valid contracts made with the Supplier as per the e-pay systems supported by the Cvetita Herbal platform.

 5. Obtain information for new articles,

6. Make e-statements related to contract execution and performance for contracts made with participants in the platform of Cvetita Herbal via the interface in the web page: www.CvetitaHerbal.com, accessible on the Internet,

7. Receive information regarding the rights arising out of the law, mainly through the interface in the web page: www.CvetitaHerbal.com, on the Internet,

8. Enjoy their right to reject, as applicable, pursuant to the Consumer Protection Act.

The Supplier   of the Cvetita Herbal platform  shall arrange goods delivery and guarantee the rights of the Users, as provided for by the law,  in a bona fide manner, subject to the approved criteria and provisions of consumer and trade laws,

Users shall make a contract with the Supplier in the Cvetita Herbal platform for purchase-sale of the articles, at https://www.CvetitaHerbal.com. Contracts will be executed in Bulgarian language and will be kept in the Supplier’s database in the platform.

Pursuant to the contract made with the Users for purchase-sale, the Supplier of the Cvetita Herbal platform shall arrange delivery and transfer of title onto the User of the goods chosen by the user via the interface of the platform for goods. Users shall have the right to amend any errors when entering details, not later than sending a statement for contract execution with the Supplier of the Cvetita Herbal platform.

Users shall make payment as compensation to the supplier selected within the Cvetita Herbal platform for delivery of the goods, subject to the terms and conditions as specified in the Cvetita Herbal platform and these general terms and conditions. The amount of compensation shall be as specified by the Supplier in the Cvetita Herbal platform at the address of the Cvetita Herbal platform on the Internet.

Using the Cvetita Herbal platform the user can select the supplier of user chosen goods, subject to the terms and conditions as specified in the Cvetita Herbal platform and these general terms and conditions.

The User and the Supplier of the Cvetita Herbal platform shall agree that all statements made between them in relation to the execution and performance of the purchase-sales contract can be made electronically and via e-statements pursuant to the E-docs and e-signature act and article 11 of the E-Trade act.

It shall be assumed that, e-statements made by the Users of the site are made by the individuals identified via the details as provided by the User upon registration subject to entry of user name and password for access.

  1. Concerning the privacy of your details

Cvetita Herbal shall handle and undertake measures to protect the personal details of its users subject to the provisions of the Personal details protection act. Users shall agree that, Cvetita Herbal shall have the right to handle their personal details in relation to the use of the website services.

In order to provide service and perform your orders, we would need to receive the following information:

 First and last name

 E-mail

 Contact phone

 Address for invoicing and delivery

 Postal code

 Thereafter you can amend these details in your personal profile.

The details to be obtained upon making a purchase order, registration or page navigation will be used exclusively to provide services for you – acknowledgement and performance of purchase orders, Subscription for new, contact with you in case of issues related to the purchase order and improvement of services extended by Cvetita Herbal.

We warrant that, these details shall not be disclosed notwithstanding the form, to any third parties and/or for any purposes different from the abovementioned.  User that have subscribed for news can terminate their subscription at all times via the link shown at the end of each piece of news.

 Your user profile can be deleted by the Cvetita Herbal system with all pertaining details if you wish so.

The declaration of privacy of personal details shall constitute integral part of these General Terms and Conditions.

  1. Purchase Order

    In order to place a purchase order, the Customer shall register or provide identification as per the rules and the terms as specified in these general Terms and Conditions, and shall log into the system via Customer name identification. The web site www.CvetitaHerbal.com provides an option for a „Quick Purchase Order " , whereby the customer shall provide only a contact phone that will only be used for completion of the purchase order and subsequent contact with the customer.

  Every product /service purchase order via the Cvetita Herbal system is bound to payment obligations via your chosen method of payment. Orders can be accepted on a 24-hours basis, weekends and official holidays included.  While placing an order you can review the articles you wish to buy and their relevant prices, your names, e-mail, phone, address, postal code, delivery method and payment method.

 Upon completion of a purchase order, and if it is your first order to the contact phone shown, you will receive a call from us with a confirmation of the said details.  For every other purchase order thereafter, you will receive only a confirmation via e-mail.

   For changes in the status of the purchase order (acknowledgement, processing, shipping, etc.) you will be advised via e-mail or phone. The status of your current purchase order and previous orders can be tracked in your personal profile. In the absence of availability of an article, Cvetita Herbal reserves the right to contact you and possibly reject your order or perform such order as soon as the missing article has been delivered.

  1. Prices

   Product prices offered by the online shop are those indicated in the web page of Cvetita Herbal as of the order date, except for case of obvious error.

All process are in BGN, VAT included. Product prices are quoted excluding shipping costs. For shipping costs, refer to the following page: http://www.cvetitaherbal.com/dostavka or you can obtain information in the progress of placing an order.

Cvetita Herbal reserves the right to change prices, at all times without prior notification, of the products offered by the online shop and such changes shall not interfere with any orders placed until such time.

Cvetita Herbal can provide discounts for the products offered on its online shop subject to Bulgarian law and the rules specified by Cvetita Herbal. The rules applicable for such discounts can be found at the location of the specific discount. Discounts can be made available in various forms (such as promotions, individual discounts for loyal customers, random-based discounts or due to participation in a contest or consumer study|.

Different discount types shall not be combined when placing a purchase order or purchasing a single article. 

  1. Issues when performing an order

   Although we do our utmost to perform all orders accurately, the performance of your order may be prevented due to any of the following reasons:

  1. We do our best to maintain stock and makeup inventories in a timely manner, however it might be possible that any of the products ordered to be unavailable; in that case, we shall contact you as soon as possible on the phone or via an e-mail message.
  2. You have chosen "Card Payment“, or PayPal, but payment was not effected or there is a delay in payment.
  3. You have shown incorrect or incomplete delivery details – names, address, phone, or postal code.

   In the event of any discrepancy between products supplied and products ordered or in case of any inaccuracy attributable to us,   we shall cover the costs for subsequent return and replacement of non-conforming goods. If delivery shall become impossible for nor reason attributable to Cvetita Herbal, (if you could not be reached at the address as shown; or if you do not respond to the supplier’s calls), your shipment will be returned to and held by us until we manage to reach you.

  1. Payment

We can offer 3 payment methods:

  1. Payment upon delivery: you receive your shipment and pay to the courier.
  2. Payment when picking the goods from a shop of the distributor network – you on site upon acceptance of the goods ordered.
  3. Payment via PayPal: you pay in the progress of placing an order.
  1. Delivery and acceptance of the products
    1. Delivery made to an address: to be selected in the progress of placing an order upon filling in an exact address, names, postal code, preferred delivery date and any further instructions.
    2. Acceptance on site, shipping upon request, to be received from a courier office: to be specified in the progress of placing an order after you have chosen your preferred date and time of acceptance.
  1. Order rejection and return

You can return the goods purchased from us without reason within 14 days from the purchase date, subject to the following conditions:

 The products shall be in the original package.

 There shall be no signs of use, deterioration of appearance or dirt.

 You shall enclose the original invoice or purchase order form as received with the products (attached to your shipment you will receive a document – a fiscal receipt for payment on delivery or an invoice, if you choose so|.

 Costs for return of the goods shall be at your expense.

  Yu can have replacement products with different products, or you can have refund of their value, in case you do not wish replacement goods. We refund the product value, excluding delivery costs. All amounts paid upon delivery or on site will be refunded only via a bank transfer to your bank account within 14 days from the date of your notice to us regarding the rejected purchase order.

  All amounts paid via a debit/credit card will be refunded to the same bank account (card) as used to make payment.

  1. Claims and queries to us

  Most kindly, contact us at phone number: +359 988 393 509, to discuss with us any queries related to products or services delivered by Cvetita Herbal.

The User shall have the right to claim any discrepancy of the goods agreed upon/ordered in case such discrepancy compared to the sales contract has been found following delivery.

The User shall have no right to claim any defects caused by improper use of the product, excessive load or use, contrary to the instructions for use, the guarantee and/or the technical features of the goods.

The User shall have the right to claim any goods whether or not the manufacturer or the seller has provided a sales guarantee for the foods or services.

In case of claim being settled via replacement of the goods with new goods, conforming to the contract, Cvetita Herbal shall maintain the same initial guarantee terms as provided to the User.

Upon claiming any article, the user can claim refund of the value paid, or replacement of the goods with new goods conforming to the contract or a price discount.

Claims shall be made verbally to the contact number provided by v Cvetita Herbal, or in writing to the e-mail address shown, or by mail or onsite at the company address.

When making a claim, the user shall specify the point of claim, user preferred method of claim settlement, and respectively, the amount claimed the address, phone number and е-mаіl for contact.

When making a claim, the user shall attach   documentary evidence in relation such claim, specifically:

1. Payment receipt or invoice,

2. Reports, acts, etc. documents in evidence of non-conformity of goods/services compared to those agreed,

3. Other documents reasoning the claim and amount claimed,

4. Guarantee card, if any.

In case of discrepancy of a consumer article compared to the ales contract, and if the User has not been satisfied with the claim settlement, the user shall have the right to choose any of the following options:

1. Terminate the contract and receive refund for the amount paid, 

2. Price reduction.

The user cannot claim refund of the amount paid or price reduction for the goods, provided that the seller has agreed to make replacement of the consumer goods with new goods.

The amount will be refunded within 14 working days from the date of arrival of the goods to our warehouse/office, subject to inspection. The monies will be transferred to the bank account a=shown in the form. A mandatory condition is that the beneficiary of the bank account shall be the same individual as shown in the purchase order. If the products is free from defects and if the product has been returned not because of being deficient, however you have decided to enjoy your right to return the goods within a maximum of 15 days from your purchase order; we reserve the right to deduct the costs for 1-off courier service amounting to BGN 5.

 Sectoral Conciliation Commission for Dispute Resolution in the Field of Electronic Communications

Conciliation proceedings is free of charge for the parties and the parties will not pay a fee for dispute settlement. The language for customer claims filed with the committee for dispute settlement in the sector of e-communications and the language of conciliation proceedings shall be Bulgarian. The subject matter of disputes covered by the scope of this procedure of the said authority can be national and cross border type between consumers and sellers in the field of e-communications. Economy sector: e-communications. Disputes will be reviewed in absentia based on documents, evidence, expert opinions, and the opinions of the parties. The procedure will be performed in writing. The procedure will be finalized with a written suggestion for conciliation, for dispute settlement between the parties and it is optional in its nature.  Upon approval of the suggestion by the two parties, it will have the effect of an agreement between the two parties. Reasons for rejection of dispute review as per the exceptions in article 181(4), clause 5 of the Consumer protection act, as provided for in the Rules for the activity of the general and sectoral conciliation commissions:

1) A dispute beyond the competence of the commission,

2)  The user did not try to settle the dispute with the seller directly,

3)  Three years have passed from the date of dispute,

4)  It has been found that the said dispute has been referred for settlement by the court/arbitration court, or has been referred to for settlement by a different authority in an out-of-court procedure, including an open procedure through mediation or to the authorities for pre-court proceedings.

  1. Information on card payments -  BORICA systems:


The card system BORICA  ensures  acceptance/ acknowledgement  of  all payment cards issued on the territory of the country, for all terminal devices ATM’s and POS’s and Internet Sellers covered by the system; routing authorizations with foreign cards to international card schemes such as  MasterCard, VISA, AMEX, Diners Club, Discover.

BORICA provides the Internet sellers with a system for secure payments via the Internet through the schemes Verified by Visa for VISA cards and  MasterCard SecureCode for MasterCard. With these payments, further to the standard process of payment authorization, there is a possibility for an additional authentication of the cardholder via password entry. Therefore, cardholders have a much higher level of control for using their cards in the Internet, minimizing the probability for unauthorized use and increasing security for online purchases.

In case of service supplier disputing any transactions performed without additional authentication of the cardholder, such dispute will be settled in favor of the seller subject to the rules of VISA and MasterCard.
